This Privacy Policy addresses the information that we collect about you through your use of the EN-R-G Foods LLC, d/b/a “Honey Stinger” (hereafter, “Honey Stinger”, the “Company”, “we”, “us” or “our” (as the context may require)) website (the “Website”) (available at www.honeystinger.com).  This Privacy Policy is part of, and incorporated into, the terms and conditions of the Website Terms of Use (the “Terms of Use”), available at https://honeystinger.com/policies/terms-of-service, which govern your use of the Website. At Honey Stinger, we respect your privacy and are committed to protecting it through our compliance with this Privacy Policy.

“Information” Collection and Retention. This Privacy Policy applies to information that we collect (“Information”), including, without limitation, the following:

• We collect Information that you provide directly to us, including Information that you provide when you register for the Website or purchase products through this website. Information we request may include, without limitation, name, email address, date of birth or other information.  We need this Information to verify our right to permit your use of this site, based upon your age and applicable law, to provide products, services or information you request, to contact you in connection therewith, or as further described herein. We may retain this Information for other uses as more fully set forth below;
• We collect the Information that you upload to the Website as described below and in the Terms of Use;
• We collect Information related to your submission of orders or other submitted requests, including Information necessary to bill you and to administer and deliver to you any products or activate any services purchased or licensed, as applicable, through this Website;

We may retain Information related to you for as long as your account is active or as needed to deliver products or provide you services through the Website. We may retain and use Information related to you, as necessary, to comply with our legal obligations, resolve disputes, and enforce our agreements.  There might be latency in deleting Information from our servers, and backed-up versions might exist after deletion. In addition, we do not delete from our servers files or materials that you have in common with other users or Information that we may otherwise be required to maintain under this Privacy Policy, our Terms of Use or for compliance with other requirements, such as for legal purposes.

Personally Identifying Information

Personally Identifying Information, or “PII”, is Information that can be used on its own or with other information or data to identify, contact or locate a single person (including, without limitation, postal address, e-mail address, telephone number, social security number or other similar identifiers).  Your submission of, and our handling of, PII is governed by this Privacy Policy and your submission of any such PII constitutes acceptance of this Privacy Policy.

We may use your PII for purposes such as responding to your requests, fulfilling your orders of products, monitoring and providing the services inherent in the Website, maintaining your account, enforcing our rights and the rights of third parties, investigating and ensuring compliance with the Terms of Use, and to contact you, if necessary, in relation to any of the foregoing.

Compliance with Nevada Law

To the extent applicable, Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to Honey Stinger via the following methods: by emailing customerservice@honeystinger.com or by calling 866.464.6639.  However, please know we do not currently sell data triggering that statute's opt-out requirements.

Other State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

• Confirm whether we process their personal information;
• Access and delete certain personal information;
• Data portability; and
• Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

• Correct inaccuracies in their personal information, taking into account the information's nature processing purpose; and

Our Use of Collected Information

In addition to the foregoing, we may use Information, including, but not limited to, PII, to:

At times, Honey Stinger may provide third parties and/or service providers with certain Information and PII to provide, or improve, our products and services, including to deliver products, or to help Honey Stinger market to consumers. Information and PII will not intentionally be shared by us with third parties and/or service providers for their marketing purposes or for a subsequent sale without our consent. However, Information and PII collected by unrelated third parties and/or service providers are governed by their privacy practices and we encourage you to learn about the specifics of their privacy practices.

Additionally, Honey Stinger may disclose Information and PII that we collect, or you provide as described in this Privacy Policy:

• To our affiliates.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Honey Stinger’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Information and PII held by Honey Stinger about our Website users is among the assets transferred.

This Privacy Policy applies solely to Information collected through our Website. In an attempt to provide you with increased value, we may include third-party links on our Website or integrate the Website with third-party applications. These linked sites and applications have separate and independent privacy policies and we may not have any control or rights in such third party sites and applications. We, therefore, have no responsibility or liability for the content and activities of these linked sites or applications, or your activities conducted through them. Nonetheless, we seek to protect the integrity of our Website and welcome any feedback about these linked sites and applications.

In addition, some content or applications, including advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies, or other similar programs, to collect information about you when you use our Website. The Information they collect may be associated with your PII or they may collect information, including PII, about your online activities over time and across different websites and other online services. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an email at customerservice@honeystinger.com or call us at 866.464.6639 to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

As noted above, residents of certain states, such as California, Nevada, Colorado, Virginia, and Utah may have additional personal information rights and choices.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Honey Stinger uses a GoDaddy SSL certificate during checkout or in your “My Account” area to protect your information. This gives us the ability to take your order information securely using 2048-bit encryption technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Information/PII, we cannot guarantee the security of any Information transmitted to our Website. Any transmission of your Information, including PII, is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Our Policy Toward Children

The Website is intended to be used only by users who have reached the age of majority in the jurisdiction in which they reside (which in most states is 18 years old) or who have reached the age of 16 and have the permission of a legal guardian (e.g., a parent) to use the Website.  If you are under the age of 16, you may not use the Website or any content, materials, products or services made available on or through the Website. If we learn we have collected or received PII from a person under the age of 16 without verification of parental consent, we will delete that information. We will respond within one (1) month of the receipt of a compliant request to exercise these rights.

Third Party Pixels and Cookies

When you visit our website, log in, register or open an email, cookies, ad beacons, and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address.
